Opening Meeting Law

The City of Holbrook adheres to Arizona’s Open Meeting Law (A.R.S. § 38-431 et seq.), ensuring transparency and public participation in all City Council, board, and commission meetings. This law mandates that public bodies conduct their deliberations and decisions openly, fostering accountability and trust in local governance.

Key Provisions:

  • Public Access: All meetings of Holbrook’s public bodies, including City Council and advisory committees, are open to the public, allowing residents to attend and observe deliberations (A.R.S. § 38-431.01(A)).

  • Notice Requirements: Meeting notices and agendas are posted at least 24 hours in advance, excluding Sundays and holidays, at City Hall and on the city’s website (A.R.S. § 38-431.02(C)). Access agendas via the Agendas & Minutes page.

  • Minutes and Recordings: Written minutes or recordings of all meetings, including executive sessions, are maintained and available for public inspection within three working days (A.R.S. § 38-431.01(B)(D)). Minutes include the date, time, place, attendees, and a description of matters discussed or actions taken.

  • Public Participation: Residents may request to speak at City Council meetings by submitting a Request to Address City Council form. A “Call to the Public” may be included on agendas, though responses are limited to agenda items (A.R.S. § 38-431.01(H)).

  • Executive Sessions: Limited closed sessions are permitted for specific purposes, such as personnel matters or legal advice, but final decisions must occur in public (A.R.S. § 38-431.03). Affected employees may request public discussion instead.

  • Compliance and Enforcement: Violations may result in actions being nullified, civil penalties up to $500 per violation, or removal from office for intentional breaches (A.R.S. § 38-431.05, § 38-431.07). The Arizona Ombudsman-Citizens’ Aide offers resources and investigates complaints (azoca.gov).
